Terms of Service

These Terms of Service ("Terms") govern your use of Preferium AI Edge (the "Service") provided by Preferium AS("we", "us", "Preferium").
1. Acceptance
By accessing or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization.
2. The Service
Preferium provides server-side optimization of customer websites for AI search engines. The Service:
- Crawls customer-published HTML on the customer's behalf
- Generates AI-optimized variants of titles, descriptions, headings, structured data, and other on-page elements
- Serves the optimized variants to AI crawlers (and optionally human visitors) via Cloudflare's edge network when the customer points DNS at us
- Provides a dashboard for reviewing, deploying, and rolling back optimizations
- Tracks AI search visibility (LLM citation rates, AI Overview presence)
3. Account
To use the Service you must:
- Be at least 18 years old (or the legal age of majority in your jurisdiction)
- Provide accurate registration information
- Keep your password / sign-in link secure
- Be responsible for all activity under your account
We reserve the right to suspend accounts that:
- Violate these Terms
- Are 30+ days past due on payment
- Are used for content that violates law or third-party rights
4. Acceptable use
You may not use the Service to:
- Optimize content that violates law (defamation, copyright infringement, IP theft, fraud)
- Attempt to manipulate search results through cloaking or hidden content (we serve identical semantically-optimized HTML to crawlers and humans by design)
- Reverse-engineer the optimization prompts or AI rewriter pipeline
- Resell the Service without an Enterprise reseller agreement
- Submit prompts intended to extract data from other tenants
- Abuse free-trial accounts (multiple sign-ups, throwaway emails for free credits)
5. Customer content
You retain all rights to your website content. You grant Preferium a non-exclusive, worldwide license to:
- Crawl, store, and process your published HTML to provide the Service
- Generate AI-rewritten variants
- Cache optimized variants at edge nodes for low-latency serving
This license terminates when you close your account, subject to the deletion timelines in our Privacy Policy and DPA.
You are responsible for the legality of your content and represent that you have all necessary rights to it.
6. AI-generated content
The Service uses third-party LLMs (Anthropic Claude, OpenAI GPT, Google Gemini) to generate optimization suggestions. AI output:
- Is suggested, not guaranteed
- Should be reviewed before deployment (we provide preview + manual override flows)
- May contain factual inaccuracies — you are responsible for verifying claims before deploying optimized content
- May reflect biases inherited from the underlying training data
When you deploy AI-rewritten content, you take editorial responsibility for it. Preferium does not guarantee the legal, factual, or commercial accuracy of any AI-generated suggestion.
7. Plans and billing
7.1 Subscription plans
Plans are described at /pricing. Plans include a monthly credit allowance (1 action = 1 credit), a domain quota, and feature access.
7.2 Billing
- Subscriptions auto-renew at the end of each billing period unless cancelled
- Cancellation takes effect at the end of the current billing period; service continues until then
- Annual subscriptions are billed up-front; we do not pro-rate refunds for unused months
- Add-on credit packs are charged once at purchase and added to your balance immediately upon Stripe webhook confirmation
- We use Stripe for payment processing; Stripe holds your card details
7.3 Plan changes
You can upgrade at any time (charged pro-rata via Stripe). You can downgrade at the end of the current billing period. Plan changes are managed via the Stripe Customer Portal accessible from Settings → Billing.
7.4 Refunds
We offer a 14-day satisfaction-guarantee refund for new subscriptions. After 14 days, refunds are at our discretion and generally not granted. Mistaken or duplicate charges are always refunded.
8. Service-level
We target 99.9% uptime for the edge worker (which serves your customer-facing traffic). Status: status.preferium.com.
The dashboard and API worker have a 99.5% target — these are tools for managing optimizations, not customer-facing critical-path infrastructure.
If we miss the SLA in a given calendar month, customers on Pro and Enterprise tiers receive service credits per the table in §7.1 of the Master Services Agreement (Enterprise) or pro-rata for Pro.
9. Termination
You may terminate at any time via Settings → Billing → Cancel subscription.
We may terminate for material breach (30 days' notice) or for non-payment (immediate, after 30 days past due).
On termination:
- Your domains stop being served by our edge within 24 hours
- Customer DNS continues pointing at us until you redirect — we serve a 503 with a notice to the visitor explaining the service has been cancelled
- Your data is preserved for 30 days for export, then deleted (see Privacy Policy §6)
10. Disclaimer
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee:
- Specific search engine rankings or AI citation rates
- That AI-generated content is factually accurate
- That third-party LLM providers will remain available or unchanged in capability
- That sub-processor data centers will not experience outages
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PREFERIUM'S TOTAL LIABILITY UNDER THESE TERMS IS LIMITED TO THE FEES YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM.
WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, LOST GOODWILL, OR BUSINESS INTERRUPTION.
This does not limit liability that cannot be excluded by law (e.g. gross negligence, fraud, personal injury).
12. Governing law
These Terms are governed by Norwegian law. Disputes will be resolved by Oslo District Court. EU consumers retain the rights granted by their local consumer protection law.
13. Changes
We may update these Terms. Material changes are notified via email to the workspace owner at least 30 days before the change takes effect. Continued use after the change indicates acceptance.
